Internal Law of Maitriyana Buddhist Community
Maitriyana Buddhist Community has an international school open to the entire humanity, having as its purpose the creation, transmission and preservation of the compassionate wisdom (karuna-prajna). To meet this Purpose (Dharma) it is established a direct and permanent contact with the universal thought, by using Mindfulness to the global problems.
Maitriyana Buddhist Community contributes creatively to the evolution of culture through Buddhist studies, and by means of investigations in the fields of Psychology, Psychotherapy, Psychiatry, Medicine, Education, Philosophy, Art, Ethics, Science, Ecology, Politics, Economy, Sociology, Law, Anthropology, History and Theology. But it also is seeking the spiritual conquest of the world by the realization of an art of teaching of the peak knowledge (satori).
Maitriyana Buddhist Community is a commune (Sangha) of masters, teachers and apprentices, procuring the integrative and reconciling formation of all components that infuse in the subject the spirit of ethical righteousness and social responsibility. To this end, its Schools are training original professionals and revolutionary researchers with a socially engaged vocation, always ready to serve the world by channelling the graduates towards teaching tasks so that they can nurture and transform their relationship with society.
Maitriyana Buddhist Community has no attachment to any ideology within the fields of knowledge, ensuring the students the fullest Freedom of expression. However, the School is not indifferent to the social problems, objectively studying the knowledge’s without falling into the trap of ideology.
Maitriyana Buddhist Community not only has a School of higher education, but it also has the goal of practicing social and cultural activities directly and revolutionarily.
Maitriyana Buddhist Community impartially studies the problems of the world, exposing their root causes and providing spiritual counselling to individuals, institutions and countries with the detached interest in participating in the project of building a better world.
Article 1 – Maitriyana Buddhist Community is not regulated by any state authority, having a Spiritual School which continues with the ancient educative system of the Buddhist People. Nevertheless, the institution is legal because it relies on the International Law of Human Rights. Thus, Maitriyana Buddhist Community have the right to promote, develop and maintain the institutional structures of Buddhist people and their distinctive customs, traditions, procedures and educative practices, simultaneously adhering to internationally recognized standards such as Declarations, Covenants and International Conventions on Education, especially emphasizing the “169th Convention of the International Labour Organization (ILO) on Indigenous and Tribal Peoples” of 1989, along with the “UN Declaration on the Rights of Indigenous Peoples” of 2007.
Article 2 – The “ILO Convention 169 Concerning Indigenous and Tribal Peoples in Independent Countries” said: “Article 27. 3. In addition, governments shall recognise the right of these peoples to establish their own educational institutions and facilities, provided that such institutions meet minimum standards established by the competent authority in consultation with these peoples.”
Article 3 – The “United Nations Declaration on the Rights of Indigenous Peoples” said: “Article 14 –1. Indigenous peoples have the right to establish and control their educational systems and institutions providing education in their own languages, in a manner appropriate to their cultural methods of teaching and learning. 2. Indigenous individuals, particularly children, have the right to all levels and forms of education of the State without discrimination. 3. States shall, in conjunction with indigenous peoples, take effective measures, in order for indigenous individuals, particularly children, including those living outside their communities, to have access, when possible, to an education in their own culture and provided in their own language. Article 15 –1. Indigenous peoples have the right to the dignity and diversity of their cultures, traditions, histories and aspirations which shall be appropriately reflected in education and public information.”
Article 4 – Maitriyana Buddhist University is registered as Institutional Member of ATALM Association of Tribal Archives, Libraries, and Museums.
Article 5 – Maitriyana Buddhist University is registered as Full Member of Argentina Association of Ecology (legal status n°359970)
Article 6 – Maitriyana Buddhist Community has an educative power leaded by Maitriyana Buddhist University, Integral Buddhist University and United Buddhist Nations University.
Article 7 – Maitriyana Buddhist Community has an executive power leaded by World Association of Buddhism.
Article 8 – Maitriyana Buddhist Community has a judicial power leaded by International Buddhist Ethics Committee & Buddhist Tribunal on Human Rights.
Article 9 – Maitriyana Buddhist Community has a legislative power leaded by United Buddhist Nations Organization.
Article 10 – Maitriyana Buddhist Community is member of the International Peace Bureau (IPB founded in 1892, Consultative Status in UN, Nobel Peace Prize in 1910).)
FACULTIES, DEPARTMENTS AND TRAINING
Article 11 – Within Maitriyana Buddhist Community the similar or related knowledge’s are grouped into Faculties and Departments which are units of teaching of professional careers. Although these Faculties and Departments depend directly from the Rector of the University, they can be linked with other institutes.
Article 12 – The Faculties and Departments are constantly renewed through the investigations carried out by both masters and students, cooperating with each other in the deepening of new study material which conform the careers programs. By means of the Faculties and Departments it is coordinated personalized teaching that receives the apprentice, orienting him or her in the realization of research papers.
Article 13 – The theoretical or practical teaching transmitted at Maitriyana Buddhist Community is taught, directed or supervised by the highest hierarchical staff: The Rector and Vice rector. The teaching is completely dialectical and personalized, encouraging the frequent contact between student and professor in order to develop in the mind the aptitudes of observation, analysis, reasoning, concentration, Mindfulness and peak knowledge (Satori). But it is also stimulated in students the ability to learn by themselves, having curiosity, openness, humility, initiative, responsibility and a critical spirit.
Article 14 – Maitriyana Buddhist Community provides the apprentices the access to artistic and spiritual self-realization, even in the Faculties and Departments oriented towards complex and technical disciplines. This implies a complete dedication for providing ethical and cultural advanced training, strengthening the integrative development of subjectivity.
INVESTIGATION AND STUDY PROGRAMS
Article 15 – Along with the dialectic methodology, the Research Papers are the primary method of evaluation of all the Faculties and Departments of Maitriyana Buddhist Community, so that the assignment of arduous processes of exploration and the inquiry in knowledge are a normal and inherent activity that every student experiences, striving for increasing the difficulty of the research in so far as the student disposes of the appropriate resources.
Article 16 – Maitriyana Buddhist Community has a School or centre of studies but it is also a laboratory of thought devoted to the task of forming cutting-edge researchers specialized in complex and radical knowledge’s.
Article 17 – The Faculties and Departments are created according to the highest standards of knowledge, seeking to train the best professionals of the most revolutionary disciplines, provided that the student engagement enables the regular functioning of teaching.
Article 18 – Maitriyana Buddhist Community has an International, Trans-cultural and Non-Governmental School. However, it tries to have a spiritual collaboration and support from individuals and institutions for the development of research and teaching, always reserving the right to choose the orientation and spiritual direction of the studies.
Article 19 – The programs of study and their periodic modifications, together with the creation of new careers and courses, are run by the Rector and Vice-rector, but syllabus also depend directly on the hard work of research on the part of students, the assistant professors and tenured masters. Programs and teaching methods are adapted to pedagogical, postmodern and spiritual principles by applying humanitarian values in the social environment.
Article 20 – The admissibility conditions to both studies and educational establishments are resolved by the Rector and Vice-rector.
Article 21 – At this institution of cutting-edge teaching it is imparted peak knowledge (satori), ensuring the ethical formation of apprentices. Accordingly, the careers and courses have a fundamentally experimental or experiential feature.
STUDENTS AND APPRENTICES
Article 22 – They will be recognized previous knowledge’s coming from both academic qualifications granted by other colleges and research centers, as well as derived from non-formal spiritual transmission processes.
Article 23 – In order to receive a certification, the students must accredit theoretical and practical knowledge, effecting and approving research papers which are corresponding to the evaluation of careers chosen. In order to pass the research work the student must have a minimum score of 80% on the scale of 1 to 100.
Article 24 – There is the possibility of accepting free apprentices who have no dialectics with the professor nor perform related research papers. For these special types of students, the School will determine special revalidation and evaluation tests.
Article 25 – Maitriyana Buddhist Community does not only organize degree careers but also postgraduate courses, by training professionals in specialties valuable for the good of society.
Article 26 – Maitriyana Buddhist Community encourages the vocation of learning, perfecting and research in their students by establishing plans so that the graduate incorporates a teaching that offers both conditions of self-realization mind and possibilities of transforming the world.
Article 27 – Maitriyana Buddhist Community offers its students and associate members the opportunity of working at School, thus developing the most of their aptitudes.
Article 28 – Maitriyana Buddhist Community requires that students and apprentices refrain from inappropriate behavior, such as violence, theft, sexual abuse, lying and drug addiction. These are the basic rules of conduct of the school.
Article 29 – Maitriyana Buddhist Community requires that students and apprentices commit themselves to a life of righteousness in understanding, thought, speech, conduct, livelihood, effort, attention and concentration. This righteousness is essential in learning.
Article 30 – Since Maitriyana Buddhist Community is an International Tribal Spiritual Community, its Masters and Students must follow the teachings of the 7 grandfathers of the Anishinaabe Nation, which are Humility (Dbaadendiziwin), Courage (Aakwa’ode’ewin), Honesty (Gwekwaadziwin), Wisdom (Nbwaakaawin), Truth (Debwewin), Respect (Mnaadendimowin) and Love (Zaagidwin).
Article 31 – Students may not be allowed to enter to the School, or may be expelled, if they exhibit perverse or psychotic behavior during the course, especially when such students disrespect to the teachers and the School.
Article 32 – Students should resolve the conflicts with Maitriyana Buddhist Community by means of the International Buddhist Ethics Committee.
PROFESSORS AND MASTERS
Article 33 – The teaching personnel in charge of Maitriyana Buddhist Community consists of two categories: a) tenured masters in charge of Faculties and Departments; b) Assistant professors in charge of introductory courses. The whole of tutors shall have the specific task of teaching, the transintelectual creation and the management work of the School. While the tenured master has an exclusive dedication to the teaching, the creative research and spiritual direction of the School, the assistant professor has a partial dedication because he or she is able to deal with other issues.
Article 34 – At Maitriyana Buddhist Community the educational staff, whether they are tenured masters or assistant professors, they do not charge any remuneration for their services.
Article 35 – They can be invited as assistant professors for the dictation of introductory courses or conferences certain tutors coming from any country in the world who demonstrate an outstanding ability in academic activity and are dedicated to special researches.
Article 36 – Tenured masters constitute the core of teaching and research within Maitriyana Buddhist Community, participating simultaneously in the direction of the School because they bear the primary responsibility for compliance with the Purpose (Dharma) of Maitriyana Buddhist Community. Therefore, tenured masters may be appointed only by the Rector or by a majority of the Directing Council of the School by impartially choosing fully trained applicants who are empty of any ideological discrimination or nationalist favouritism. In this sense, the ethical integrity, social righteousness and compassionate wisdom (karuna-prajna) are the fundamental conditions for admitting tenured masters, establishing at all times that the absence of such features will never be able to be compensated with intellectual or academic merits.
Article 37 – Any member of the Steering Committee of Maitriyana Buddhist Community can take the initiative to postulate a tenured master or assistant professor but the approval of such application will always rest with the Rector or the majority of the Directing Council.
Article 38 – The tenured masters constitute the highest hierarchy of teaching in the School. Therefore, to be a tenured master of a Faculties and Department it is required to have demonstrated an extraordinary ability in the integral training of disciples and apprentices, being author of works that are decisive contributions to the discipline of the Department. The Rector and Vice-rector shall regulate the obligations and rights of tenured masters at all times.
Article 39 – Although the designation of tenured masters has a perennial character, the tenured master has the duty to submit each year to the Rector the reports on the work performed during that period. In case the Rector or Vice Rector does not consider such a report satisfactory it will begin a review process in the Directing Council about the continuity of the tenured master.
Article 40 – In the case of assistant professors, their designation is not perennial, being under a constant spiritual monitoring of their performance to analyze whether their practice is satisfactory or whether it is better than other applicants for the post. The assistant professors are a lower hierarchy than that of tenured masters, which does not necessarily mean they depend entirely on their superiors, except in cases in which it is explicitly solved by the Directing Council of Maitriyana Buddhist Community in order to safeguard teaching and study programs.
Article 41 – Maitriyana Buddhist Community opens its doors to instructors from around the world to hire assistant professors, which creates a stimulating environment for spiritual activity and effective teaching.
Article 42 – The positions held by the Rector and Vice-rector are not open to convocations, except before eventual loss situations of physical integrity or suspension of post on the part of the Directing Council.
Article 43 – The rights and obligations of the assistant professors are to develop introductory courses partially or completely in accordance with the guidance of the tenured masters. They can also collaborate as assistant in the dictation and evaluation of a career in charge of a tenured master. The Rector or Vice Rector can order the assistant professors special tasks that are necessary for the teaching and research of Maitriyana Buddhist Community.
Article 44 – Every several years, the assistant professors have the duty to renew their ideas and knowledge through new specializations and enhancements. Maitriyana Buddhist Community offers specializations to their assistant professors in order that they develop the highest standards of teaching and research.
Article 45 – There are no age limits to stop teaching at Maitriyana Buddhist Community, since old age is not an impediment to the full exercise of teaching. At this School there are no retirement or emeritus positions. However, in case of withdrawal of a tenured master he or she may be hired as a advisor of the Directing Council. The tenured master shall always have the right to teach for life, except in cases of behaviour incompatible with the Directing Council.
Article 46 – Those professors who dictate a pre-existing course which then is endorsed by the School will be considered free educators of Maitriyana Buddhist Community. The endorsement can be provided both by the Rector, Vice Rector and by the Directing Council.
Article 47 – Assistant professors and tenured masters may be subjected to university judgment, this being a process initiated facing an accusation founded by students or tutors of the School. The grounds that might lead to expulsion are the breach of pedagogical duties, didactic incompetence, lack of spiritual honesty and participation in acts devoid of dignity, ethics and justice. In case of an unfavourable university judgement filed against the professor or master, the academic certifications these individuals have received by Maitriyana Buddhist Community will immediately expire. The universities judgements will be performed by the International Buddhist Ethics Committee.
SOCIALLY ENGAGED FUNCTION
Article 48 – Maitriyana Buddhist Community establishes compassionate and solidarity relationships with all the peoples of the world, being a tool for improving society. Thus, its headquarters provides assistance through the service of social action and the ideals of the compassionate wisdom (karuna-prajna), always seeking the Awakening (Bodhi) of all humankind, reason why any discrimination of a political, economic, cultural, racial and religious nature is strongly prohibited.
Article 49 – With the Purpose (Dharma) of Liberty, Equality and Fraternity, Maitriyana Buddhist Community provides special scholarships for students around the world, both at Face-to-face Education and at Distance Education, helping them to attain peak knowledge (satori). However, any student who has full scholarship and does not financially contribute he or she then should contribute spiritually, regularly participating as a Jury member of the International Buddhist Ethics Committee & Buddhist Tribunal on Human Rights, since the practice of mutual support is encouraged as an essential feature of the tribe or spiritual commune (sangha) of Buddhist people.
Article 50 – In the case of resident students for periods of long duration at the School, the Maitriyana Buddhist Community has the obligation to provide food, shelter and spiritual therapeutic care, reason why it cannot provide them full scholarship at this face-to-face modality.
Article 51 – Maitriyana Buddhist Community organizes intensive face-to-face trainings, whose cost includes accommodation, food and therapeutic assistance.
Article 52 – Maitriyana Buddhist Community organizes free short-term seminars, assuming responsibility towards popular education.
Article 53 – Maitriyana Buddhist Community fosters relationships with other universities of the world, whether Buddhist or not, organizing covenants.
Article 54 – Maitriyana Buddhist Community, by Maitriyana Buddhist University, has signed in 2015 an International Agreement with the Autonomous University of Guerrero from Mexico.
Article 55 – Maitriyana Buddhist Community publishes and disseminates the spiritual work of its members and associates, prioritizing the more significant works for the universal culture. The School then stimulates activities that truly contribute to the social transformation of the world, seeking the consolidation of democracy, human rights, pacifism, social justice and planetary harmony.
ASSETS/EQUITY AND EXPENSES
Article 56 – Maitriyana Buddhist Community lacks of possessions registered in its name. However, the Rector and Vice-rector have ceded a land of their property for building the School which is where face-to-face trainings are performed. In addition, the Rector and Vice-rector have given in to Maitriyana Buddhist Communitythe library and technology resources that compose it.
Article 57 – Any future donation that is received for the School must always be used for the common good and never for selfish aims.
Article 58 – The Maitriyana Buddhist Community resources are mainly the payment of fees by students. That money is used for the shaping of the budget, whose principal items are the food of educational body, building maintenance of the school, the maintenance of the international temple World Association of Buddhism, buying of office supplies, the postal delivery of certificates, payment of electricity and internet services, paying taxes, buying books for the library, the healthcare of adopted animals, donations to poor families, donations to official representatives and travels to teach in other countries. Other possible income sources established by Statute are: contributions derived from other institutions or companies seeking to be sponsors, the publication of books written by the Rector and Vice Rector, and the provision of therapeutic services.
Article 59 – The tuition fees are not a payment for the study material received, but a contribution for the tutoring provided, as well as access to education with the possibility of certification. The funds are deposited to the School for their immediate implementation.
Article 60 – Refunds are not allowed for the payment of fees as long as the educational service has been properly provided.
Article 61 – Any expenditure or investment must be on those items covered by the budget approved by the Rector and Vice Rector.
ADMINISTRATION OF THE SCHOOL
Article 62 – The government of Maitriyana Buddhist Communityis constituted by the Directing Council, its presidents or maximum authorities being the Rector and Vice-rector. In case of death or absence of both figures the Directing Council should vote their replacements.
Article 63 – The Directing Council – composed by the Rector, the Vice Rector and the Secretaries – can change the Statute with the vote of a simple majority. However, the Founding Rector of the School has right of veto.
Article 64 – The secretaries of the Directing Council must change frequently.
Article 65 – For the correct functioning of Maitriyana Buddhist Community, the majority of the Directing Council shall be in accordance with the Rector and Vice Rector about various issues such as the Statute, admission requirements, the syllabus, discipline dialectics, the revalidation of certificates, the Departments, the creation or deletion of careers and courses, scientific and artistic work of the School, the delivery of Honorary Doctorates or awards to outstanding thinkers, the designation of professors, the designation of secretaries, and the items of budgeting.
Article 66 – The Directing Council will be able to suspend and dismiss the Vice Rector or even the Rector provided there is a proven incapacity or breach of duties after the internal procedure of university judgment.
Article 67 – To be Rector or Vice Rector of Maitriyana Buddhist Community there is no nationality or age requirements but having been Professor or Master in the School. The new Rector or Vice Rector may be elected by the Directing Committee or be directly appointed by the former Rector or Vice Rector for an indefinite period.
Article 68 – In cases of absence, severe illness, suspension, expulsion, resignation or death of the Rector, his or her functions shall be exercised perennially by the Vice Rector and in the lack of the latter they shall be exerted by the Directing Council before choosing a replacement.
Article 69 – The Rector is the highest representative of Maitriyana Buddhist Community, having special duties and responsibilities: teaching, convening the Directing Council, performing institutional arrangements, the approval of degrees and certificates issued by the School, directing the Departments, exercise discipline in the field of Maitriyana Buddhist Community, designating secretaries of the Directing Council members, propose professors, preparing syllabus, evaluate students, the knowledge revalidation of graduates from other schools, approve the teaching of assistant professors, propose admission conditions, being a representative of the World Association of Buddhism, correctly implement the budget funds, meeting the needs of the School and comply with the Statutes at all times.
Article 70 – The Rector of Maitriyana Buddhist Community will have an exclusive dedication and Mindfulness towards teaching, so he or she will be the tenured master of all careers, at the same time he or she shall represent the School in its inter-university and extra-university relationships.
Article 71 – Those circumstances that are not explicitly or implicitly provided in the Statute of Maitriyana Buddhist Community shall be rapidly decided by the Rector and Vice Rector, following the fundamental principles of the Spiritual Purpose (Dharma).
After 13 years of uninterrupted education, on November 24, 2018, the new Internal Law of Maitriyana Buddhist Community entered into force.
